Terms and Conditions

These Terms, together with our Privacy Notice and any other policies referenced in them, form the entire agreement between you and the Company in relation to your use of the Platform.

We may amend these Terms from time to time in accordance with Section 16 (Changes to These Terms). Your continued use of the Platform after any changes take effect constitutes your acceptance of the revised Terms.

If there is any conflict between these Terms and any other communication or document, these Terms shall prevail in relation to your use of the Platform.

In these Terms, the following words have the following meanings.

"Account" means the personal account you create in order to access and use the Platform.

"Commissioner" means the user who creates a Private League and who has administrative rights over that Private League as set out in Section 7.

"Content" means any text, data, graphics, team names, league names, images, or other material submitted, posted, or displayed by a user on or through the Platform.

"League" means a group of Teams competing against one another based on the real-world performance of selected golfers, whether a Public League or a Private League.

"Private League" means a League created by a Commissioner that other users may only join by invitation or using a unique join code.

"Public League" means a League that is open for any registered user of the Platform to join.

"Team" means the fantasy golf team or squad of real-world golfers that a user selects and manages through the Platform.

"User", "you", or "your" means any individual who registers for, accesses, or uses the Platform.

To create an Account and use the Platform, you must be at least 16 years of age. By registering, you confirm that you meet this minimum age requirement.

The Platform is intended for users located in the United Kingdom. We do not represent that the Platform is appropriate, legally permitted for use, or available in any other location, and access from territories where the Platform's content is illegal or restricted is prohibited.

We may, at our discretion, refuse to register any individual as a user, or may suspend or terminate an existing Account, where we reasonably believe the eligibility requirements in this Section 3 are not met.

The Platform is entirely free to use. There is no charge to register an Account, create a Team, create or join a League, or otherwise participate in the Service.

The Service does not charge any entry fee, does not require any form of payment or stake from users to participate, and does not offer any cash prizes, vouchers, goods, or other rewards of any kind to any user, League winner, or Team. Participation is for entertainment purposes only.

Because there is no entry fee, stake, or prize of any kind, the Service is a free skill-based game and is not a lottery, bet, or form of gambling. Outcomes on the Platform are determined by users' skill and judgement in selecting and managing their Team based on the real-world performance of golfers in actual golf tournaments, and not by chance in the sense relevant to gambling legislation.

We reserve the right to introduce prizes, rewards, paid features, or paid entry in the future. If we do so, we will update these Terms accordingly and, where required by law, implement appropriate additional terms, age verification, or regulatory compliance measures before any such features go live. No such features are currently offered.

To use the Platform, you must register for an Account by providing your name, a team name, a valid email address, and a password. You agree to provide accurate, current, and complete information during registration and to keep this information up to date.

You are responsible for maintaining the confidentiality of your password and Account credentials and for all activity that occurs under your Account. You must notify us immediately at info@majorfantasygolf.com if you become aware of any unauthorised use of your Account.

You may only register and maintain one Account. Operating or attempting to operate multiple Accounts is prohibited under Section 8 (Fair Play and Prohibited Conduct).

We are not liable for any loss or damage arising from your failure to comply with this Section 5, including your failure to keep your password secure.

Once registered, you may create a Team by selecting real-world professional golfers in accordance with the squad-building rules displayed on the Platform from time to time, which may include limits on the number of golfers, budget or value caps, and transfer or substitution windows.

Your Team's performance in a League is calculated using a scoring system based on the real-world performance of your selected golfers in designated golf tournaments, as published and explained within the Platform. We may update scoring rules between tournaments or seasons, and will take reasonable steps to notify users of any material change before it takes effect.

You are solely responsible for the golfer selections you make and for managing your Team, including observing any deadlines for selections, transfers, or substitutions. We are not responsible for any missed deadlines or selections not saved due to your own error or delay.

You may create or join a Public League, which is visible and open for any registered user to join, subject to any capacity limits we may apply.

You may create a Private League as its Commissioner. As Commissioner, you are responsible for managing membership of that Private League, including inviting and, where the Platform permits, removing members, setting the League name, and sharing the League's join code or invitation link only with individuals you wish to invite.

We take no responsibility for the composition, administration, or any disputes arising within a Private League, including disputes as to membership, Commissioner decisions, or League naming, save that we may intervene where conduct breaches these Terms.

We reserve the right to remove, rename, suspend, or disband any League (Public or Private) at our discretion, including where a League name or associated Content breaches Section 9 (Content and Acceptable Use) or Section 8 (Fair Play and Prohibited Conduct).

As there are no prizes or monetary stakes associated with any League, League standings and results are provided for entertainment purposes only and confer no right to any prize, payment, or benefit.

You agree to use the Platform fairly and in good faith. Without limiting the generality of the foregoing, you must not:

create or control more than one Account, or create an Account on behalf of another person without their knowledge and consent;

use any automated means, bot, script, or similar technology to create Accounts, Teams, or Leagues, or to interact with the Platform;

attempt to manipulate scoring, League standings, or any other feature of the Platform, including through collusion with other users;

impersonate any person or entity, or misrepresent your affiliation with any person or entity, including any golfer, club, or sporting body;

use the Platform for any unlawful purpose or in a way that breaches any applicable law or regulation;

interfere with, disrupt, or attempt to gain unauthorised access to the Platform, its servers, or any connected network or system; or

harass, abuse, threaten, or harm other users, including through any Team name, League name, or other Content you submit.

We may, at our sole discretion, suspend or terminate the Account of any user who we reasonably believe has breached this Section 8, and may remove any affected Team, League, or Content, without liability to you.

When you submit Content to the Platform, including a Team name or League name, you must ensure it is not offensive, defamatory, obscene, discriminatory, or otherwise inappropriate, and does not infringe the rights of any third party, including intellectual property rights.

You grant us a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, and adapt your Content solely for the purposes of operating, promoting, and improving the Platform, including displaying Team and League names to other users within the Service.

We reserve the right, but do not accept any obligation, to monitor, review, edit, or remove any Content at our discretion, including where we consider it breaches this Section 9 or any other part of these Terms.

All intellectual property rights in the Platform, including its software, design, graphics, text, trademarks (including the Major Fantasy Golf name and logo), and underlying code, belong to the Company or its licensors. Nothing in these Terms transfers any such rights to you.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for your personal, non-commercial use in accordance with these Terms. You must not copy, modify, distribute, sell, or lease any part of the Platform, nor reverse engineer or attempt to extract the source code of any software, unless permitted by applicable law.

Real-world golfer names, images, statistics, and tournament data used within the Platform remain the property of their respective rights holders. We make no claim of affiliation with, sponsorship by, or endorsement from any golfer, golf tour, club, or sporting body unless expressly stated.

We collect and process personal data about you, including your name, team name, email address, and password, in order to create and administer your Account and to operate the Platform.

We use your email address to send you service messages relating to your Account and use of the Platform, such as password resets, League updates, and important notices about the Service. These service messages are necessary for the operation of your Account and cannot be opted out of while you hold an Account.

We may also use your email address to send you news, updates, and other marketing communications about the Platform. You may opt out of marketing communications at any time using the unsubscribe link included in each message or by adjusting your Account preferences, without affecting your ability to receive service messages or otherwise use the Platform.

Further detail about what personal data we collect, how we use it, the legal bases we rely on, how long we retain it, and your rights under UK data protection law (including the UK GDPR and the Data Protection Act 2018) is set out in our separate Privacy Notice, which forms part of these Terms by reference and is available on the Platform.

We will use reasonable endeavours to keep the Platform available, but we do not guarantee that the Platform will be uninterrupted, error-free, or available at all times. We may suspend, withdraw, or restrict access to all or part of the Platform for operational reasons, including maintenance, updates, or circumstances beyond our reasonable control.

We may add, remove, or change features of the Platform, including scoring rules, League formats, and squad-building rules, from time to time. We will take reasonable steps to give notice of material changes affecting live Leagues or Teams where practicable.

You may stop using the Platform and close your Account at any time by contacting us at info@majorfantasygolf.com.

We may suspend or terminate your Account, or your access to all or part of the Platform, immediately and without notice if we reasonably believe you have breached these Terms, engaged in conduct prohibited under Section 8, or where we are required to do so by law.

On termination of your Account for any reason, your right to use the Platform ceases immediately. Provisions of these Terms which by their nature should survive termination, including Sections 10 (Intellectual Property), 11 (Data Protection and Privacy), 14 (Disclaimers and Limitation of Liability), and 18 (Governing Law and Jurisdiction), will continue to apply.

The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we exclude all representations, warranties, and conditions relating to the Platform, whether express or implied, except as expressly set out in these Terms.

As the Platform is provided free of charge, to the fullest extent permitted by applicable law, we exclude all liability for any loss or damage arising out of or in connection with your use of, or inability to use, the Platform, including any loss of data, loss of enjoyment, or disappointment, whether such liability arises in contract, tort (including negligence), or otherwise.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited under English law.

Since the Platform does not involve any entry fee, stake, or prize, you acknowledge that your use of the Platform carries no financial risk or expectation of reward, and that these Terms are to be interpreted accordingly.

You agree to indemnify and hold harmless the Company, its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your breach of these Terms or your misuse of the Platform.

We may update these Terms from time to time to reflect changes in the Service, our practices, or applicable law. We will post the updated Terms on the Platform and update the "Last updated" date at the top of this document.

Where changes are material, we will take reasonable steps to notify registered users, such as by email or an in-app notice, before the changes take effect. Your continued use of the Platform following any such change constitutes acceptance of the updated Terms.

If you have a complaint about the Platform or another user's conduct, please contact us at info@majorfantasygolf.com with details of your concern. We will investigate and respond within a reasonable time.

These Terms, and any dispute or claim arising out of or in connection with them or their subject matter, formation, or validity (including non-contractual disputes or claims), are governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms, save that if you are a consumer resident elsewhere in the United Kingdom, mandatory consumer protection laws of your place of residence may also apply and you may bring proceedings in your local courts.
